Property division

During property division, our team can assist you in drafting the property division agreement and ensure that the terms of the agreement reflect your demands. If the agreement was drafted by the other party, we will review all the terms of the agreement and inform you of any underlying risks or unfavourable terms. Our team will represent you in negotiating on the terms with the other party to reflect your demands and finalize the agreement.

Additionally, AGC Lawyers also offers legal services on pre-marriage arrangements such as prenuptial agreements. Our team can assist you in drafting a prenuptial agreement or review the agreement for you.

Assistance of legal representation

If an agreement cannot be reached on property division even with the assistance of legal representation, our team can assist you in bringing the matter to Court. Under the Australian law, property division depends on each parties’ contribution to the asset pool as well as their financial status and spending requirements. This may include child maintenance and house maintenance. Our team can provide an estimate of your contribution by assessing your role in the family, spending and required maintenances.

When dividing the asset pool, its impact upon each party in the future will also be taken into account. For example, one party to the marriage may be a homemaker and given up an opportunity to pursue a career. As such, if they have lost their ability to find employment in the workforce, spousal maintenance may be ordered by the Court. Our team can assist you in filing an application for spousal maintenance, or defend you in unreasonable or irrational claims for spousal maintenance.

Child maintenance differs from spousal maintenance as parents owe their children the obligation to care for them and provide for their needs, for children under the age of 18. If during the divorce, you have children who are underage, our team can assist you in estimating a reasonable child maintenance fee, payment options, and help you reach an agreement with the other party. If both parties cannot come to a consensus, we can also help you bring the matter to Court and represent you in Court proceedings.
